Foreclosure laws in USA are different in different states. In judicial foreclosure states the foreclosure process might run for a year before closing. But in Missouri it can be completed within a maximum of 60 days as the system is non-judicial. The matter does not have to go to court as per the laws of the state and the mortgage terms. Thus those being foreclosed upon never get a chance to present their side of the story to a judge. If the bankruptcy clause of empowering judges to alter terms of the contract had been allowed to pass by the Congress, borrowers in states like Missouri would have benefited and there would have been less number of Missouri bank repo homes.
